Who we are

This website is operated by AGS Marketing, also known as AGS • The African Agency. We are a web design, marketing and video production agency. In this policy, “we”, “us” and “our” refer to AGS Marketing.

We respect your privacy. We only collect what we need to answer you, deliver our services and improve this website. This privacy policy explains what we collect, why we collect it and the choices you have.

What this privacy policy covers

This privacy policy applies to this website, our forms and free tools, our emails and calls, and the services you buy from us. It covers two situations:

  • You visit our website or contact us. In this case, this privacy policy explains how we decide to use your information.
  • You hire us for a project. In this case, this privacy policy also explains how we handle information that belongs to your business or your customers. See “When we work on your projects” below.

Information you give us

Quote request form

When you ask for a quote, we collect your name, company, email address, phone number, website, industry, budget range, timeline and the description of your project. We use it to understand your needs and prepare an accurate proposal.

Free calculators and scorecards

Some pages offer free tools, such as the Website Leak Scorecard. When you request your results, we collect your first name, email address, your website (optional) and your answers. Then we email you your personalized report. After that, our team may send you one short follow-up message.

Strategy session bookings

When you book a call, our scheduling tool (Cal.com) collects your name, email address, phone number (if you provide it) and any notes you add. Cal.com sends the calendar invitation and reminders on our behalf.

Emails, calls and messages

We also keep anything you choose to send us by email, phone or messaging apps such as WhatsApp.

When you become a client

To deliver a project, we may collect contact details for your team, billing information, project files, brand assets, content and the access you give us to your accounts. Payments are handled by our bank or payment provider. We do not store full card numbers.

Information collected automatically

  • Technical and security data: your IP address, browser, device, and the date and time of your visit. Our hosting and security tools use it to protect the website and block spam. For example, our forms briefly use your IP address to limit repeated submissions.
  • Analytics: how visitors use the website, such as pages viewed, time on page, scroll depth, buttons clicked, forms started and bookings completed. See “Analytics” below.

How we use your information

  • To answer your questions, prepare quotes and organize strategy sessions.
  • To send you the reports you request and a short follow-up from our team.
  • To deliver, support and invoice the services you buy from us.
  • To keep this website secure and prevent spam and abuse.
  • To measure and improve our website, content and marketing.
  • To send occasional marketing emails, only where allowed. You can unsubscribe at any time.
  • To meet our legal, tax and accounting obligations.

We do not sell your personal information. We also do not use it to make automated decisions that have legal effects on you.

Legal bases

Where laws such as the GDPR apply, we rely on these legal bases:

  • Contract: to prepare a quote you request and deliver the services you buy.
  • Consent: for optional cookies, advertising tags and marketing emails where required. You can withdraw your consent at any time.
  • Legitimate interests: to secure our website, measure its use, reply to inquiries and follow up on a request you made.
  • Legal obligations: to keep accounting records and answer lawful requests.

Analytics

We use Google Analytics, an analytics tool provided by Google and added to our website with the MonsterInsights plugin.

Google Analytics uses cookies to help us understand, in aggregate, which pages and tools are useful. Google Analytics 4 does not store IP addresses. Where the law requires it, these cookies are only set after you consent. You can also opt out at any time, as explained below.

To opt out of Google Analytics on all websites, you can install Google’s opt-out browser add-on: tools.google.com/dlpage/gaoptout

Cookies and similar technologies

  • Essential cookies keep the website working and secure, and remember your language choice.
  • Third-party content may set its own cookies or receive your IP address when a page loads. This includes the Cal.com booking calendar, Google Fonts and the content delivery networks that serve our page scripts.
  • Analytics or advertising cookies are only used with your consent where the law requires it.

You can block or delete cookies in your browser settings. However, some parts of the website may not work properly without essential cookies.

Advertising

We may advertise our services on platforms such as Google, Meta (Facebook and Instagram) and LinkedIn. If we add their tracking tags to this website, for example to measure our ads or show ads to past visitors, we will only do so with your consent where it is required, and we will update this policy.

Who we share it with

We only share your information with trusted providers who help us run our business, and only as needed:

  • Our website hosting and security providers.
  • Google, which we use to send and receive emails (Gmail) and to measure website use (Google Analytics).
  • Cal.com, which we use to schedule calls and send invitations (see the Cal.com privacy policy).
  • Our bank, payment and accounting providers, when you pay an invoice.
  • Specialist partners or freelancers working on your project, under confidentiality obligations.
  • Professional advisers, or authorities when the law requires it.

These providers may only use your information to provide their services to us, in line with this privacy policy.

When we work on your projects

Our services include custom website design and website packages, SEO, paid ads management, social media management, brand identity design, brand video production, AI chatbots, lead-capture tools, automated follow-up emails, website care and launch campaigns. Delivering them sometimes means handling information that belongs to your business.

Our role

When we process personal information on your behalf, such as leads collected by a website, form, tool or chatbot we build for you, you remain in charge of that information. In this case, we act as your service provider (a “processor”) and follow your instructions. On request, we can sign a data processing agreement with you.

Access to your accounts

To build, run or measure your projects, you may give us access to your website, hosting, domain, analytics, Google Ads, Meta, LinkedIn or social media accounts. We only use this access for the work you hire us for. We also ask that you remove it when our work ends.

Websites, tools, ads and emails we set up for you

The sites, tracking tags, ads, chatbots and email sequences we set up collect information from your own visitors and customers. You are responsible for your own privacy policy and consent banner. We are happy to help you set them up correctly.

AI chatbots

The chatbots we build may send conversations to an AI provider so they can generate answers. We tell you which provider is used, set the chatbot up to avoid collecting sensitive information, and do not use your customers’ conversations to train our own models.

Video production and photography

When we film or photograph people, we ask for their permission before using their image or voice. In addition, we only show client work, logos and testimonials in our portfolio when we are allowed to.

At the end of a project

We return or delete the personal information we handled for you, unless the law requires us to keep it. We keep project files only as long as needed to support you, unless you ask us to delete them sooner.

International transfers

Our team works in Senegal and Canada. Also, some of our providers store data in other countries, including the United States and the European Union. When your information is transferred abroad, we take reasonable steps to keep it protected, in line with applicable law.

How long we keep it

  • Quote and tool requests: as long as needed to answer you and follow up. After that, we delete them if you do not become a client.
  • Client records: for as long as required by accounting and legal obligations.
  • Analytics data: only as long as it is useful to improve our website.

You can ask us to delete your information at any time, as explained below.

How we protect it

We use reasonable technical and organizational measures to protect your information. These include secure connections (HTTPS), access controls, security monitoring and limited access for our team. No system is completely secure. However, if a security incident affects your information, we will inform you and the authorities when the law requires it.

Your rights

Depending on where you live, you may have the right to:

  • Access the personal information we hold about you.
  • Correct inaccurate information.
  • Ask us to delete your information.
  • Object to or restrict certain uses, including marketing emails.
  • Receive a copy of your information in a portable format.
  • Withdraw your consent at any time.

To make a request, simply email info@ags.work. We will reply as soon as possible. You can also contact your local data protection authority. For example, this may be the Commission de protection des données personnelles in Senegal, the Commission d’accès à l’information in Québec, or the authority in your country.

Every marketing email we send also includes a way to unsubscribe.

Children

This website is intended for businesses and is not directed at children under 16. We do not knowingly collect information from children.

Changes to this privacy policy

We may update this privacy policy from time to time, for example when we add a new tool or service. The latest version will always be available on this page, with the date of the last update at the top.
